UPDATE: The court subsequently issued an order giving the company until 4 PM on Thursday to show cause why the appeal of the District Court ruling is not now moot. Good luck with that. Posted at right as well.
After issuing what appeared to be a contradictory opinion, the state Supreme Court has now issued a final order on the arena petition by Caesars Entertainment: The description of effect is invalid, so the petition is, too.
This was inevitable after the court first said the description was misleading, but inserted a footnote that said the peition could stay on the ballot. This clears up the confusion — unfortunately for Caesars, and fortunately for MGM/Boyd, which fought against it.
My guess is this is not the end of Arena Wars, though ...
The order is at right (two justices said the case should have returned to District Court, but fact is the original high court order had to be remedied and quickly).
