Dr. Dipak Desai, the primary owner of the clinic that caused the nation’s largest healthcare facility-caused Hepatitis C outbreak, surrendered his medical license to the Nevada State Board of Medical Examiners Wednesday.

The surrender was based on the same logic pointed out in an October Las Vegas Sun story: How is Desai fit to hold a medical license when his attorneys argue that his strokes have caused him to be mentally incompetent to defend himself in the Hepatitis C-related lawsuits?

Desai had stopped practicing because of a court injunction. But he could have returned to practice if the injunction had been lifted.

The medical board said in a statement that the surrender was due to “physical and mental impairments arising from a series of strokes.”

The surrender cannot be revoked and will not stop the pending disciplinary case against Desai, the medical board statement said.
