The Nevada Supreme Court has declined to hear a challenge of a state Legislature effort to siphon $62 million from Southern Nevada sewer project funds for the state budget.
In a one-paragraph order issued Wednesday, the state's only appellate court said the matter should first be heard in a district court.
The case stems from a refusal by the Henderson-based Clean Water Coalition and businesses including the M Resort to turn over the money following a special state Legislature session on an $805 million state budget crisis.
The coalition and casino argue the state lacks authority to take money from an account funded by ratepayers for the specific purpose of southern Nevada clean water projects.
The state and Legislature petitioned the court March 18 to order the transfer.
