Court upholds man’s conviction in fatal drive-by shooting

CARSON CITY — The Nevada Court of Appeals has upheld the voluntary manslaughter conviction of Terrence K. Bowser in a drive-by shooting in Las Vegas in 2004.

The court, in a decision released today, rejected claims that there was improper evidence introduced at trial, juror misconduct and that the sentence of 12 to 30 years in prison was too harsh.

Bowser was driving a vehicle when passenger Jamar Green fired a shotgun at another vehicle, killing John McCoy, 60, near Lone Mountain Road and Decatur Boulevard, in what at the time was described as a road rage incident.

Green pleaded guilty to first-degree murder and was sentenced to 34 years to life in prison.

Bowser initially was convicted of murder and five other counts and was sentenced to 30 years to life, but that verdict was overturned.

At a second trial, he was found guilty of voluntary manslaughter and two counts of discharging a firearm.

The court, in a decision written by Judge Michael Gibbons, rejected arguments by attorneys for Bowser that there were errors made at the second trial that required a reversal of the convictions. The court also upheld the sentence.
