Elko police: Shooting death of boy was a ‘tragic accident’

ELKO — Elko police say the fatal shooting of a 10-year-old boy by a 12-year-old boy at the older child's home was a “tragic accident" and no criminal charges will be filed.

A police statement said the 10-year-old was found dead on Wednesday with a single gunshot wound to the chest and that a subsequent investigation determined that a 12-year-old boy had fired the shot, the Elko Daily Free Press reported.

“After consulting with the Elko County DA’s Office and evaluating the physical evidence and witness statements, this case was determined to be a tragic accident and no criminal charges are forthcoming,” police said in a statement.

Police Lt. Mike Palhegyi said the firearm was locked up but the 12-year-old was able to access it. The 10-year-old friend was a friend of the older boy and visiting his home.

Palhegyi said the incident was a reminder of the responsibility that comes with gun ownership.
