Nevada joins states in filing response over health reform

Nevada joined 19 other states today in responding to the federal government’s motion to dismiss a lawsuit against federal health care reform.

The 20 states involved in the suit say the health care reform act is unconstitutional and infringes upon the sovereignty of the states.

The U.S. Department of Justice filed a motion to dismiss the case in June, saying the act was allowed under Congress’ authority and the lawsuit was filed too early.

The states responded today by arguing that money already is being spent on planning and operational activities states must undertake to meet the federal requirements.

“Nevada families are already footing the bill just to set up pre-planning for the Reid/Obama Nationalized Health Care Plan,” Gov. Jim Gibbons said today in a statement. “This unconstitutional and ill-conceived nationalized health care plan is sick and will trample the constitutional rights of all Nevada families.”

The lawsuit was filed in federal court in Florida after President Obama’s signing of the act on March 23.

Nevada joined the lawsuit May 14 after Gibbons, a Republican, recruited Las Vegas attorney Mark Hutchison to represent the state when Democratic Attorney General Catherine Cortez Masto decided not to do so.
